Alternative provision by reason of exclusion
Permanent Exclusions
If a child is permanently excluded, the local authority must arrange full-time education by the sixth school day after the exclusion.
This is the child’s home authority, even if the school is in another area.
This duty is under Section 19 of the Education Act 1996 and is managed by the Alternative Provision Panel.
- For KS3 and KS4 pupils, the panel will usually recommend a Pupil Referral Unit (PRU).
- For KS1 and KS2, the panel will decide if the child can attend the primary PRU or needs another type of provision.
Fixed Period Exclusions (Suspensions)
For suspensions, the responsibility is with the school’s governing board, under Section 100 of the Education and Inspections Act 2006.
